The Uganda peoples Defence forces (UPDF) General Court martial sitting in Makindye, Kampala and chaired by Brig Gen Freeman Mugabe, has today Tue 2nd May 23 Sentenced one of it own Pte Amaitum Clement Kapel 26 years old to One Year Ten Month and Twenty days imprisonment to Kitalya government prison.

He was charged with the offence of Murder c/s188 and 189 of the Penal Code Act Cap 120 on the 30th day of March 2021 and pleaded not Guilty. 

Since then,Pte Amaitum has been battling murder charges, for causing the death of Pte Peter Aloku in the night of 22 Feb 2019 at Kapeka road , heading to Singo training school in Nakaseke District.  Amaitum was a soldier of 45Bn under BGXXV11.

When the case came up on 24th April 23. Counsel for the state Lt Rasto Alex Mukhwana informed court that they had agreed with the counsel for the accused that the charge be amended to Manslaughter  . The amended charge was read to the accused and he pleaded guilty for having killed a colleague while on a security operation in Nakaseke and therefore was convicted of his own plea of guilty. 
 
Under the law, Manslaughter contravines section 187 (1) and 190 of the penal code Act. The brief facts of the case were read to the accused and accepted them to be true .

While passing the sentence,  Brig Gen Freeman Mugabe the Chairman General Court martial said having listened to both counsels for the state and accused and after Mitigations Court came up with a punishment of One (1) year ten (10) months and twenty (20) days imprisonment. The accused had been in lawful custody for the last four (04) years and in the Army for five (05) years . He advised him to appeal in case not happy with the sentence within 14 working days .
